Procedure for MPP supplies to foreign states
The Russian Federation establishes the following procedure for supplies of military purpose products to foreign states.
1. A foreign customer (competent authority and MTC entities of foreign states, or international organizations representing the interests of a foreign state) sends an application signed by an authorized official of a foreign customer to FSMTC or directly an MTC entity. The application should indicate a range and quantity of MPP and a recipient state.
2. FSMTC:
registers an application;
delegates an MTC entity to consider an application;
informs a foreign customer of acceptance of its application for consideration;
agrees on the level of foreign trade prices for MPP to be exported;
makes a decision on import to and export from the Russian Federation of MPP and submits to the Government of the Russian Federation draft resolutions of the President of the Russian Federation and the Government of the Russian Federation in respect of MPP import and export;
registers a contract; and
issues a license for MPP import (export).
3. An MTC entity:
studies applications of a foreign customer jointly with relevant federal agencies and organizations to determine capabilities to manufacture MPP and deadlines for their supply;
carries on negotiations with a foreign customer;
requests from a foreign customer duly legalized: a certificate of an end user, a copy of a document entitling a foreign customer to foreign trade activity relating to military purpose products, copies of registration documents and a copy of the document confirming its competence to act in the interests of a competent authority of a foreign state – the recipient of military purpose products;
draws up draft a resolution on MPP supplies and agrees thereon with relevant federal executive authorities and sends the same to FSMTC;
agrees with FSMTC on a contract for MPP supplies;
signs and submits a contract to FSMTC for registration;
obtains from FSMTC a license for MPP import (export);
submits a license for MPP import (export) to the customs authority; and
arranges for shipment of military purpose products.
